Welcome to Biel.ai, a service provided by Volcanic Labs SLU. These terms and conditions ("Terms") govern your use of our website, products, and services (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Intellectual Property

All content, excluding user-generated and AI generated content, and materials available on our website and through our Services, including but not limited to text, graphics, logos, images, and software, are the property of Biel.ai or its licensors and are protected by applicable intellectual property laws. You may not use, modify, reproduce, distribute, or create derivative works of any content or materials without our prior written consent. Any feedback or suggestions provided by users remains the intellectual property of Biel.ai.

2. Use of Services

You agree to use our Services in compliance with all applicable laws and these Terms. Any activities conducted through your account are your sole responsibility. Unauthorized or inappropriate use, including violations of laws, regulations, or infringing on others' rights, will result in account cancellation.

3. Privacy and Data Protection

Our Privacy Policy, compliant with the General Data Protection Regulation (GDPR), governs the collection, use, and disclosure of your personal information. By using our Services, you consent to the practices described in our Privacy Policy.

4. Service Availability and Warranty

Our Services are provided "as is," without warranties of any kind, whether expressed or implied. While we strive for excellence, we cannot guarantee uninterrupted service, timely availability, or that the Services will be error-free or free from harmful components. 5. Payments, Cancellations, and Refunds

First-time subscriptions: New subscribers receive a free trial. After the trial, initial payments for paid subscriptions are non-refundable.

Monthly subscriptions renewals: If you cancel a monthly subscription, no further charges will be made. However, there are no refunds for the current month. You will retain access until the billing period ends.

Annual subscription renewals: If you cancel within 30 days of renewal, a full refund will be issued. Cancellations after 30 days will not be refunded, but you will retain access for the remainder of the subscription year.

7. Quota Management

Upon reaching 80% of your allocated message or indexed pages quota, Biel.ai will issue a notification prompting you to consider upgrading your subscription plan. Failure to upgrade upon reaching the quota limit may result in the temporary suspension of certain features, including but not limited to the chatbot service, until such time as the quota is reset at the commencement of the next billing cycle or an upgrade is processed.

8. AI-generated content disclaimer

Our Services may include content generated by artificial intelligence ("AI"). Biel.ai does not guarantee the correctness, completeness, or legality of AI-generated content. Users are solely responsible for any actions taken based on such content. Biel.ai disclaims all liability for any decisions or actions arising from the use or reliance on AI-generated content. By using our Services, you acknowledge and agree that any use of AI-generated content is at your own risk and discretion.

9. Chat Interactions

By installing and using the Biel.ai chatbot widget on your website, you agree to handle all chat interactions, including any personal data shared by users, in compliance with applicable privacy laws such as GDPR. You are responsible for ensuring that your use of the chatbot and any associated data is lawful and in accordance with your privacy policies. Biel.ai is not liable for any misuse of user data collected through the chatbot on your website.

When you engage with a chatbot widget provided by Biel.ai and installed on a client's website, you acknowledge that the content of those interactions, including personal data, may be shared with the respective client for the purpose of providing the chatbot service. All such data is subject to confidentiality agreements and will be handled securely in accordance with GDPR and other applicable privacy laws.

10. Limitation of Liability

To the maximum extent permitted by law, Biel.ai and its affiliates, partners, directors, officers, employees, and agents disclaim all liabilities, be it direct, indirect, incidental, or consequential, arising from the use of our Services.

In any event, our total liability to you, for any and all claims, will be limited to the amount of fees you have paid for the Services in the 12 months preceding the claim.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts in Spain.

12. Modifications to Terms

Biel.ai may modify these Terms occasionally. Continued use of our Services post-modification implies your acceptance of the revised Terms.

13. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, or acts of civil or military authorities.
